Overview

These Terms of Service (the “Terms”) set forth the conditions for use of the ITTI ONLINE SHOP (the “Service”), operated by IQUALITY Co., Ltd. (the “Company”).

Through its physical stores and website, the Service provides customers with all related information, content, features, tools, products, and services (collectively, the “Services”). The Service is hosted on Shopify and operated by the Company.

These Terms of Service and all policies referenced herein explain the rights and responsibilities of customers when using the Service.

By browsing, accessing, or purchasing through the Service, customers are deemed to have agreed to these Terms of Service and the Company’s Privacy Policy.

Article 1 – Access and Accounts

Customers represent that they have reached the age of majority in their place of residence, or that parental or guardian consent has been obtained if the user is a minor.
The Company may require customers to provide necessary information such as name, address, email address, and payment details. Customers warrant that all provided information is accurate and up to date.
Customers are responsible for managing their account information and all activities conducted under their account.

Article 2 – Products

The Company strives to display product information accurately; however, colors and appearance may differ depending on the viewing environment.
Product specifications, prices, and availability may be changed or discontinued without prior notice.

Article 3 – Orders

An order constitutes an offer to purchase and is deemed accepted when confirmed by the Company.
The Company reserves the right to refuse or cancel orders at its discretion.
Returns and exchanges will be handled in accordance with the Company’s Refund Policy.

Article 4 – Pricing and Payment

Prices displayed at the time of order apply. Shipping fees, handling fees, and taxes may be added separately.
Customers agree to pay the displayed amount using a valid payment method.

Article 5 – Shipping and Delivery

Delivery dates are estimates only, and the Company is not responsible for delays.
Ownership and risk of loss transfer to the customer once the product is handed over to the shipping carrier.

Article 6 – Intellectual Property

All content included in the Service belongs to the Company or rightful owners.
Use beyond personal, non-commercial purposes is prohibited.

Article 7 – Optional Tools

The Company is not responsible for the content or accuracy of tools provided by third parties.

Article 8 – Third-Party Links

Use of third-party websites is at the customer’s own risk.

Article 9 – Relationship with Shopify

The ITTI ONLINE SHOP is hosted by Shopify; however, all purchase contracts are formed directly between the customer and the Company.
Shopify bears no responsibility for transactions between the Company and customers.
Customers agree to indemnify Shopify and its affiliates from any claims arising from such transactions.

Article 10 – Privacy Policy

Personal information is handled in accordance with the privacy policies of the Company and Shopify.

Article 11 – Feedback

Any reviews or feedback submitted by customers may be used by the Company free of charge.

Article 12 – Errors

If errors are found in descriptions or pricing, the Company may correct them or cancel orders.

Article 13 – Prohibited Conduct

Fraud, resale for commercial purposes, infringement of third-party rights, or interference with Service operations is prohibited.

Article 14 – Termination

The Company may suspend or terminate the Service as necessary.

Article 15 – Disclaimer of Warranties

The Service and products are provided “as is” without warranties of fitness for a particular purpose.

Article 16 – Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for indirect or consequential damages.

Article 17 – Indemnification

Customers agree to indemnify the Company for damages arising from violations of these Terms or unlawful conduct.

Article 18 – Severability

If any provision is deemed invalid, the remaining provisions shall remain in effect.

Article 19 – Entire Agreement

These Terms constitute the entire agreement between the Company and customers.

Article 20 – Assignment

Customers may not assign rights or obligations under these Terms.

Article 21 – Governing Law and Jurisdiction

These Terms are governed by Japanese law, and the Tokyo District Court shall have exclusive jurisdiction.

Article 22 – Headings

Headings are for convenience only and do not affect interpretation.

Article 23 – Gift Cards (ITTI E-Gift Card)

Gift cards may be used only on the official ITTI online store.
They are issued by email and are valid for five (5) years from the date of issuance.
Returns, refunds, exchanges, and reissuance are not permitted.
Deferred payment methods (bank transfer, cash on delivery, convenience store payment, Pay Later services) are not accepted.
The Company may invalidate gift cards if fraudulent use is detected.

Article 24 – Changes to the Terms

The Company may revise these Terms at any time.
